Booking.com must comply with DMA regulation to ensure fair competition

In May 2024, Booking Holdings Inc. (BHI) was designated as a “gatekeeper” under the EU’s Digital Markets Act (DMA). As a result, it will have to signifcantly alter how it interacts with business users and other travel service providers. In particular, parity clauses or clauses with similar effects will now be banned, allowing businesses to provide consumers with diverse conditions across different sale channels. Booking.com is now also required to provide real-time data to business users, allowing such services insight to consumer behavior. Booking has submitted a compliance report which will be scrutinized by the Commission.
