Directive (EU) 2024/2853 of the European Parliament and of the Council of 23 October 2024 on liability for defective products and repealing Council Directive 85/374/EEC has been officially published. The directive updates the EU’s rules on liability for defective products, particularly in light of technological and legal advances made since the previous 1985 Directive. It aims to foster innovation and maintain fair competition in the internal market, while expanding its scope of application to include modern products – such as software, artificial intelligence, and digital services. In fact, software is now explicitly regarded as a product. However, open-source software is exempt, unless integrated into commercial products. It extends compensation for damages to personal and psychological injury, property damage, and data loss. Economic operators will be held liable for defective products, regardless of fault. By addressing gaps in the previous directive, this legislation aims to encourage the uptake of new technologies while ensuring manufacturers have a clear understanding of their responsibilities.
