Advocate General Spielmann has proposed the Court of Justice overturn the General Court’s ruling in EDPS v. SRB (C-413/23 P). The issue is whether data shared during Banco Popular’s resolution process was personal data in Regulation 2018/1725. Spielmann argued that the General Court erred by not protecting such data, believing that any data identifiable to people—pseudonymized or not—ought to be safeguarded. The upcoming Court of Justice decision will be instrumental in defining personal data and accountability standards in the EU.
