Commission fines Meta €797.72 million for abuse of dominant position

The European Commission has fined Meta €797.72 million for the violation of Article 102 TFEU on the abuse of dominant position. The Commission retains that Meta has been tying its ads service Facebook marketplace to the personal social network Facebook and is imposing unfair trading conditions on other ads service providers. As a result of the tying conduct, Facebook users are automatically and regularly exposed to Facebook Marketplace. The Commission holds that the conduct risks copmetition foreclosure. Moreover, the unfair trading conditions Meta imposes on other ads services allows the platofmr to use ads-related data generated by those other advertisers for the sole benefit of the Facebook Marketplace.
