The European Commission has released Frequently Asked Questions (FAQs) on the Data Act (EU Regulation 2023/2584) to support its implementation ahead of its applicability on 12 September 2025.

The Data Act establishes harmonized rules for data sharing and ensures a fair distribution of data value within the EU’s data economy while safeguarding fundamental rights. Alongside the Data Governance Act, it aims to enhance trust in voluntary data-sharing mechanisms and facilitate a single market for data.

The FAQs provide technical guidance on key aspects, including scope and objectives, data access and sharing, IoT and connected products, public sector access, switching between data processing services, enforcement, and penalties. They also outline forthcoming actions, such as guidelines on reasonable compensation and model contractual terms for data sharing, to be published by the Commission.

As a living document, the FAQs will be updated as needed. However, they do not constitute the official position of the European Commission and do not create new rights or obligations beyond existing legislation.
